Acceptance of Terms
By creating an account or using the Motor Maalik app ("Platform"), operated by GrowthIQ Ventures OPC Pvt. Ltd. ("Motor Maalik," "we," "us"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.
What Motor Maalik Is
Motor Maalik is a digital marketplace that connects Vehicle Owners with Drivers for the daily rental of commercial vehicles, including auto-rickshaws, e-rickshaws, passenger cars used for taxi purposes, loaders, mini-trucks, and other light-to-heavy commercial vehicles.
Motor Maalik is a facilitator, not a party to the rental itself. We do not own any vehicles listed on the Platform, do not employ Drivers, and are not a party to the rental agreement formed between an Owner and a Driver. Our role is to connect the two parties, verify identity and documentation, process payments, and provide dispute-resolution support.
Eligibility
To use Motor Maalik, you must:
- Be at least 18 years of age (or the minimum age required to hold a valid driving license for the relevant vehicle category under Indian law, if higher)
- Have the legal capacity to enter into a binding agreement
- Complete the identity verification process applicable to your role (Owner or Driver)
Account Registration & Verification
- All users register using a valid phone number, verified via OTP.
- Owners must submit valid government ID for identity verification, and per-vehicle documents (Registration Certificate, Insurance, PUC Certificate, Fitness Certificate, Permit, Road Tax receipt) before a vehicle can be listed as available.
- Drivers must submit a valid driving license, government ID, and a photo for identity verification before they may submit any rental request.
- Motor Maalik reviews and approves or rejects submitted documents. Approval indicates the documents appear genuine and current at the time of review — it does not guarantee ongoing validity, and users remain responsible for keeping their documents current.
- Users agree that all information and documents submitted are accurate, genuine, and belong to them (or, for Owners, that they hold legal right to list the vehicle).
Owner Obligations & Warranties
By listing a vehicle on Motor Maalik, you represent and warrant that:
- You are the legal owner of the vehicle, or hold valid authorization to lease it
- All submitted documents are genuine, current, and accurately describe the vehicle
- The vehicle is roadworthy and matches its listed description and condition
- You will not knowingly permit the vehicle to be used for any unlawful purpose
- You maintain valid insurance on the vehicle at all times it is listed
Driver Obligations & Warranties
By renting a vehicle through Motor Maalik, you represent and warrant that:
- You hold a valid, current driving license appropriate to the class of vehicle being rented
- All submitted documents are genuine and belong to you
- You will operate the rented vehicle lawfully and will not use it for any illegal purpose
- You will return the vehicle in the condition received, ordinary wear and tear excepted
- You will make all rental payments as required under Section 8
Rental Process
- A Driver submits a rental request for an available vehicle.
- The Owner reviews the Driver's verified profile, license, and rating, and may Accept or Reject the request within a defined response window. If rejected or the window expires, and other Drivers have requested the same vehicle, the request passes to the next Driver in sequence.
- On acceptance, the rental status becomes "Pending Pickup." No payment is due at this stage.
- Owner and Driver arrange and complete a physical handover, during which the Driver may inspect the vehicle.
- Either party may cancel at this stage without penalty, as no payment has occurred.
- Once handover is confirmed by either party in-app, the first day’s payment becomes due, and the rental status becomes "Active."
Payment Terms
- Drivers pay rent daily, in advance, before each day of vehicle use, via the Platform's integrated payment system (UPI/Razorpay).
- Non-payment by the applicable daily cutoff, after a grace period, will result in restrictions on the Driver's account, including being unable to submit new rental requests until the balance is cleared.
- Owners are settled on a weekly basis, reflecting all payments collected on their behalf during the preceding week, less Motor Maalik's platform commission and any amount held pending an open dispute.
- Motor Maalik's platform commission is disclosed within the app and may be adjusted with reasonable notice to Owners.
- Optional damage-protection fees, where applicable, are described separately within the app.
Vehicle Return, Damage & Non-Payment
- Drivers must return the vehicle at the end of the agreed rental period, or upon early termination by either party in accordance with these Terms.
- Damage disputes and disagreements over vehicle condition are handled through Motor Maalik's in-app dispute process (see Section 11).
- In the case of extended non-payment combined with non-return of the vehicle, Motor Maalik will restrict the Driver's account and support the Owner in pursuing appropriate legal remedies, including assistance with a police report where warranted.
- Neither Motor Maalik nor the Owner will attempt to physically recover a vehicle through self-help means that could constitute unlawful conduct; all recovery must proceed through appropriate legal or police channels.
Cancellations & No-Shows
Either party may cancel a Pending Pickup rental prior to handover without financial penalty. Repeated cancellations or no-shows by a user may be recorded against their account and considered in future platform decisions, including potential account restrictions.
Dispute Resolution
- Users agree to first raise any dispute arising from a rental through Motor Maalik's in-app dispute system before pursuing external legal action.
- Disputes may be raised by either the Owner or the Driver in connection with a specific rental, within a reasonable time period after the rental starts or ends.
- Motor Maalik's admin team will review submitted evidence and may request additional information, resolve the dispute (including adjusting payment amounts as appropriate), or reject an invalid claim.
- Amounts related to an open dispute may be held from an Owner's weekly settlement until resolution.
Prohibited Conduct
Users may not:
- Submit false, altered, or fraudulent documents
- Create multiple or duplicate accounts to circumvent verification or platform restrictions
- Sublet or transfer a rented vehicle to any third party
- Use a rented vehicle for any illegal purpose
- Collude with another user to submit fraudulent claims or extract payments improperly from the Platform
- Harass, threaten, or engage in unsafe conduct toward another user
Violation of this section may result in immediate suspension or termination of a user's account.
Indemnification
Each user agrees to indemnify and hold harmless Motor Maalik and GrowthIQ Ventures OPC Pvt. Ltd. from any claims, losses, or damages arising from that user's own breach of these Terms, misrepresentation, or unlawful conduct in connection with their use of the Platform.
Limitation of Liability
To the maximum extent permitted under applicable Indian law, Motor Maalik's liability for any claim arising from use of the Platform is limited to the total value of the specific rental transaction giving rise to the claim. Motor Maalik is not liable for indirect, incidental, or consequential damages. This limitation does not apply to matters that cannot be limited under Indian consumer protection law.
Suspension & Termination
Motor Maalik reserves the right to suspend or permanently terminate any account for: submission of fraudulent documentation, non-payment, vehicle theft or non-return, repeated unresolved disputes, or any violation of Section 12.
Data Privacy
Motor Maalik's collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms.
Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes not resolved through the in-app process shall be subject to the exclusive jurisdiction of the courts of Lucknow, Uttar Pradesh.
Changes to These Terms
Motor Maalik may update these Terms from time to time. Material changes will be communicated through the app. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
